The following must be attached to the application: a copy of the applicant’s passport, a photograph, a document certifying the stay’s purpose, certificate of health insurance policy, and a sworn statement that the applicant will not claim social benefits during his/her stay in the Czech Republic (unless the purpose of his/her stay is employment or business). Validity of Residence Permit Certificates

Temporary residence permit certificates are issued for various periods of validity depending on the validity of the purpose, for which the temporary residence permit is issued, the duration of this period ranging from several months (the minimum period) to five years (employment, business). The validity of the permit may be repeatedly extended.

Permanent residence permit certificates are issued for the period of ten years; the validity of these permits may be, again, repeatedly extended.
Generally, the validity period of residence permit certificates issued to family members corresponds to the validity period of permits issued to the EU citizens being the holders of a residence permit certificate. For general information on Prague apartments click here.

a) Always (compulsory documents):

1. A passport issued to his name (a foreigner holding a passport expiring less than 90 days prior to the expiration date of his visa may be denied entry, or less than 90 days before the foreigner’s planned departure, if from a country with no visa requirement;

b) Upon request (non-compulsory documents) of the Foreign or Border Police:

The current transitory provisions stipulate, in particular, that:

  • Visas issued prior to the effective date of the new legislation shall be valid, as if issued under the new legislation
  • Permanent residency visas hitherto issued shall be valid, as if issued under the new legislation
  • Travel documents and resident visas (i.e. including permanent residency visas) shall be valid until the date of expiry marked
  • Decisions restricting residency in the CR under the former legislation shall prevail.

Foreign Nationals’ Residency in the CR

Before looking at Prague apartments we will help you with answers on residency. The aforesaid legislative update has been in effect since July 1, 2001, except Article I/71-74 (corresponding to the provisions of Sections 88 and 89 of the Act on Residency Permits for Foreign Nationals), the effective date of which is to be announced, and Article I/104, 107, 110, 114 (corresponding to the provisions of Sections 161, 163, and 164 of the Act on Residency Permits for Foreign Nationals), which came into effect on January 1, 2001.
Due to the voluminous size of the Act on Residency Permits for Foreign Nationals, this information material focuses primarily on substantial changes.  Besides, a great number of the amendments merely clarifies certain details for interpretation purposes and therefore has no influence on the rights or obligations of foreigners defined in the previous legislation.  As an example, let us mention the newly added Subsection 17a, on short-term visas, and 17b, on long-term visas, containing an account of the types of visa.
Planning on moving to Prague ? You will need these information before looking at Prague apartments.

Of the substantial amendments concerning entry and residency of foreigner nationals, let us present as follows:

  • The provision requiring a foreigner to provide a filled-out border-crossing pass with his photograph, upon request, has been abolished (a photograph will have to be added to border-crossing passes only if issued by a consular office);
  • As a new reason for preventing a foreigner from entry, it is now possible to reject him, if reasonable grounds exist for presuming that his stay in the CR might constitute a danger to the security of the state, disturb public peace, or jeopardize certain judicial or administrative decisions;
  • Members of aircraft crews are now able to stay in the CR, on a temporary basis, without a visa or passport, provided that they present a certificate proving them to be a member of a crew (in accordance with the provisions of the Chicago Convention on international air transportation of Dec. 7, 1944, as amended);

Along with our vast inventory of Prague apartments, you will find information on the residency issues.

A visa application will no longer have to contain a proof of health insurance coverage while staying in the CR (it is not necessary that a foreigner prove his ability to pay for medical care before his application is processed), but his obligation to present this proof prevails, so that the Police has the right to check this circumstance at border crossings or during residency status checks in the CR; (When looking at Prague apartments you will need this information.)

  • A foreigner’s proof of accommodation during his stay in the CR, required for visas exceeding 90 days or permanent residency visas, will no longer have to be provided with an officially verified signature of the accommodating party (thus rectifying situations where a verified signature could be requested even if the foreigner showed a confirmed reservation from a hotel’s competent representative);
  • The range of opportunities to apply for a visa in excess of 90 days has been expanded (e.g. a visa for more than 90 days for the purposes of family unification; a visa for more than 90 days for sharing household with a legal custodian, in the case of a minor-aged foreigner or adult foreigner without subsistence, provided that the legal custodian holds a permanent residency permit in the CR or is a citizen of the CR; and foreigners already staying in the CR with a visa for more than 90 days will be able to apply for an extension of over 90 days for the purposes of cohabitation, employment, or business activities);

When looking at Prague apartments you will need this information.

  • Foreigners holding a visa for more than 90 days for the purpose of business activities who apply for an extension of their visa will have to present (in addition to formerly required copy of their latest income tax return, with a stamp of the tax administration) a statement of outstanding tax liability (in cooperation with the Ministry of Finance seeking improvement in compliance with the current tax regulations);
  • The period during which a foreigner may apply for an extension of their current visa or permanent residency permit has been extended by 60 days (formerly, foreigners who were abroad on business had problems with the very short renewal period);
  • The range of foreigners who may apply for a permanent residency permit while in the CR has been expanded and the range of reasons entitling foreigners to applying for this type of status while in the CR has been expanded (with the aim to create optimal conditions for unification in families where one of the members is a foreign national; and the waiting period formerly applicable to children applying for a permanent residency permit has been abolished);

The following summarizes information about life in Prague, information you need before looking at Prague apartments.

  • New specifications apply to documents proving a foreigner’s possession of adequate funds for living in the CR, as a prerequisite to the issue of a permanent residency permit (instead of an incomplete account of concrete circumstances proving that a foreigner has and will have sufficient funds for living in the CR, the new provision contains a generally formulated requirement enabling the foreigner to meet this obligation by presenting a proof of employment, i.e., prove his ability to earn adequate funds for his subsistence, rather than having to prove possession of the required amount at the given moment);
    Experience with the practical application of the legislation led to a more detailed list of reasons justifying cancellation of a foreigner’s visa;
  • A foreigner born in the CR, whose legal custodian holds a permanent residency permit and applies for a permanent residency permit for the child, will be granted this permit until the effective date of the pending decision concerning the application (this is important from the perspective of medical care and payment thereof, as the former legislation was causing problems in this respect, especially in cases involving health insurance for newborns with congenital defects);
  • The range of cases where a foreigner’s residency permit can be terminated has been expanded, using the institute of deportation (e.g. for crossing the border as a hidden passenger); in individual cases, the period of reentry restriction will no longer be determined by tariff, defining merely the upper limit of the restriction (thus leaving certain room for taking the specific aspects and their gravity into consideration); the Police will have to weigh the consequences of this measure’s imposition on the private and family life of the foreigner;

If you have any question regarding Prague apartments don´t hesitate to contact Prague real estate agents listed in our bussiness directory.

  • The new provisions restrict operators of international bus lines from transporting a foreigner without a valid passport or visa across the border, provided that such a document is required (in accordance with the Procedural Rules arising from the Schengen Treaty);
  • The new provisions incriminate a carrier (administrative offence) who transports a foreigner without a visa to the CR, provided that a visa is required for entry;
  • The penalties for administrative offences have been newly adjusted to fixed amounts, up to an upper limit of CZK 100,000 per foreigner transported without the required documents for entry in the CR (formerly, the amount of penalty was derived from the minimum living standard, in accordance with Sec. 3/2e or Act No.463/1991 Coll., on minimum living standard, as amended);
  • The range of offences has been expanded (i.e., the range of violations of the law allowing imposition of a penalty);
  • The time limit required for processing an application for a visa for more than 90 days has been shortened from 180 to 120 days (further reduction of this time limit would cause problems due to the circumstance that distant consular offices do not maintain high-frequency communication with the head office);
  • The condition formerly discounting the length of stay of a foreigner in the CR to date as part of the period of eligibility qualifying him for a permanent residency permit in the CR has been abolished (with the aim to enable foreigners living in the CR under the terms of the former legislation to count the time already spent in the CR as part of the mandatory waiting period).
