Advertising contractual conditions

The server provider of www.paguerealtyportal.com is the company PragueRealtyPortal s.r.o. with the registered office at Ovocný trh 572/11, 110 00 Prague 1, company identification No.: 27887880, incorporated in the Companies Register kept by the Municipal Court in Prague, Section C., Insert 124331. Hereinafter referred to as the Provider. The server is provided in particular for the purposes of presentation of offer of real estates by the real estate agencies or particularly by the entities authorized to carry on the activities on the real estate market.
The party ordering the advertising on the portal (hereinafter referred to as the "Advertiser") is any physical or legal entity ordering the paid advertising on the portal website.

The Advertiser takes into account that the data on the presented real estate offers on the server are publicly available for all the Internet users.

Advertising shall be ordered on the basis of the order. Advertising is the paid service and is governed by the valid price list.¨

Advertising ordering

The Advertiser shall conclude the written order with the Provider. The order shall be concluded for the definite period of time with the possibility of extension thereof.

Invoicing

The services are invoiced under the valid pricelist, on the basis of the Advertiser’s written order, in advance in the form of the advance invoice.
The Advertiser undertakes to settle to the Provider the sum mentioned in the advance invoice, at the latest until the maturity date stated therein (the settlement day is deemed to be the day of crediting of the Provider’s account with the invoiced sum).

On the day of settlement of the advance invoice the Advertiser becomes active, i.e. its advertising begins to be published on the portal.
The Provider undertakes to issue to the Advertiser the invoice-tax document within 15 days after crediting of the Provider’s account with the invoiced sum for advertising.

If it does not pay for the ordered services duly and in time, the Advertiser breaches the business terms and conditions of the portal and the advertising shall be suspended.

The Provider reserves the right to the adjustment of prices for services.
The Provider reserves the right to reject the advertising, if the advertising:

1. Is in contradiction with the legal order of the Czech Republic
2. Is in contradiction with morality or possibly it threatens the public order
3. Does not correspond by its quality or content to the Provider’s interests

Provider’s duties

The Provider undertakes to provide the Advertiser duly with the ordered services and secure the due operation of the server.  To secure the server promotion.

In the case of non-functionality of the portal or of the ordered advertising the Provider undertakes to provide the Advertiser with the reasonable discount or free advertising extension. The period for the compensation asserting is 14 days from the day, when the Advertiser found out the Provider’s fault.

Advertiser’s duties

The Advertiser shall use for publishing and adaptation of information only such technical means, which are approved by the portal administration. The portal Provider shall not be liable for the possible mistakes, which may arise on the level of the communication protocol. The Advertiser shall not be entitled to manipulate with the data on the portal.

The Advertiser undertakes to publish only the true data, not to leave the non-current advertisements and update its advertisements in the case that the state thereof is changed and/or the data mentioned therein are changed. Solely the Advertiser shall be liable for the content and truthfulness of the mentioned data.

The Advertiser further undertakes to update regularly and in accordance with reality the data on its offers and to respond to the interest of the clients – portal visitors.

Final provisions

The contractual relation between the Provider and the Advertiser shall be governed hereby and by the Commercial Code (Act No.. 513/1991 Coll. as amended by subsequent regulations) and other applicable regulations.
The Provider reserves the right to modify these Contractual Conditions also without the prior consent of the Advertiser, in such a manner that it shall publish the latest new and full wording hereof on the portal website.

Smluvní podmínky inzerce

Provozovatelem serveru www.praguerealtyportal.com je společnost PragueRealtyPortal s.r.o. se sídlem Ovocný trh 572/11, 110 00 Praha 1, IČ: 27887880 , zapsaná v obchodním rejstříku vedeném Mětským soudem v Praze oddíl C., vložka 124331. Dále jen provozovatel. Server je provozován především za účelem prezentace nabídky nemovitostí realitními kancelářemi, resp. subjekty oprávněnými provozovat činnost na realitním trhu.

Objednavatelem inzerce na portálu (dále jen "Inzerent") je jakákoliv fyzická či právnická osoba objednávající placenou inzerci na webových stránkách portálu.

Inzerent bere na vědomí, že údaje o prezentovaných realitních nabídkách na serveru jsou veřejně přístupné všem uživatelům Internetu.

Inzerce se objednává na základě objednávky.  Inzerce je placenou službou a řídí se platným ceníkem.

Objednávka inzerce

Inzerent uzavře s provozovatelem písemnou objednávku. Objednávka se uzavírá na dobu určitou, s možností prodloužení.

Fakturace

Služby jsou fakturovány dle platného ceníku, na základě písemné objenávky Inzerenta, dopředu formou zálohové faktury. Inzerent se zavazuje uhradit Provozovateli částku uvedenou na zálohové faktuře, a to nejpozději do data splatnosti uvedeného na tomto dokladu (dnem úhrady se rozumí den připsání fakturované částky na účet Provozovatele).

Dnem úhrady zálohové faktury se stává Inzerent aktivní, tzn., že od tohoto dne se začíná jeho inzerce zveřejňovat na portálu.
Provozovatel se zavazuje vystavit Inzerentovi fakturu-daňový doklad do 15 dnů po připsání fakturované částky za Inzerci na účet Provozovatele.

Nezaplatí-li za objednané služby řádně a včas, Inzerent poruší obchodní podmínky portálu a inzerce bude pozastavena.
Provozovatel si vyhrazuje právo na úpravu cen za služby.
Provozovatel si vyhrazuje právo inzerci odmítnout pokud inzerce:

1. Je v rozporu s právním řádem České republiky
2. Je v rozporu s dobrými mravy, případně ohrožuje veřejný pořádek
3. Neodpovídá kvalitou anebo obsahem zájmům Provozovatele

Povinnosti provozovatele

Provozovatel se zavazuje řádně poskytovat inzerentovi objednané služby a zajistit řádný chod serveru. Zajišťovat propagaci serveru.
V případě nefunkčnosti portálu anebo objednané inzerce se Provozovatel zavazuje poskytnout Inzerentovi přiměřenou slevu anebo bezplatné prodloužení inzerce. Lhůta pro uplatnění kompenzace je 14 dnů ode dne, kdy Inzerent zjistil pochybení Provozovatele.

Povinnosti Inzerenta

Inzerent užívá ke zveřejňování a ůpravě informací pouze takové technické prostředky, které jsou schváleny správou portálu. Provozovatel portálu není zodpovědný za případné chyby, které mohou vzniknout na úrovni komunikačního protokolu. Inzerent není oprávněn manipulovat s daty na portálu.

Inzerent se zavazuje zveřejňovat pouze pravdivé údaje, neponechávat neaktuální inzeráty a aktualizovat své inzeráty v případě, že dojde ke změně jejich stavu a/nebo údajů v nich uvedených. Za obsah a pravdivost uváděných údajů je zodpovědný výlučně Inzerent.

Inzerent se dále zavazuje pravidelně a  v  souladu se skutečností aktualizovat údaje o svých nabídkách a  reagovat na zájem klientů - návštěvníků portálu

Závěrečná ustanovení

Smluvní vztah mezi Provozovatelem a Inzerentem se řídí těmito Podmínkami a Obchodním zákoníkem (zákonem č. 513/1991 Sb. ve znění pozdějších předpisů) a dalšími platnými předpisy.
Provozovatel si vyhrazuje právo měnit tyto Smluvní podmínky i bez předchozího souhlasu Inzerenta, a to tím způsobem, že zveřejní jejich poslední nové a úplné znění na stránkách portálu.
